Terms of Service

Acceptance and Eligibility
These Terms govern your access to and use of Poly. Poly is a property of Ethion AI Limited (SARL). By using the Services, you agree to these Terms. If you use Poly on behalf of an entity, you represent that you have authority to bind that entity. You must be at least 13 years old (or the minimum age required in your jurisdiction).
Service Description and Changes
Poly provides access to multiple AI models, tools, and workflow capabilities. We may modify, suspend, or discontinue features at any time, with or without notice, including for maintenance, legal, security, or business reasons.
We aim to route each request to the best available upstream service for your use case. In extraordinary events, outages, or provider-level disruptions, we may be unable to fulfill some requests as intended.
Poly may offer memory features that let you import memory from another provider and use that memory to improve continuity in future chats. You remain responsible for the data you import and should only submit data you are authorized to share.
Accounts and Security
- You are responsible for all activity under your account and for maintaining credential security.
- You must provide accurate information and keep it up to date.
- We may suspend or terminate accounts for fraud, abuse, legal risk, or policy violations.
- Suspension or termination for violations may result in loss of access and no refund where legally permitted.
Paid Plans, Usage, and Billing
Paid subscriptions and usage-based limits are governed by plan terms shown in-product. You authorize us and our billing partners to charge applicable fees, taxes, and adjustments.
You may cancel your subscription at any time. Cancellation stops future renewal charges, and you keep access through the end of your current billing period unless otherwise stated in-product.
If a paid request cannot be fulfilled due to an extraordinary service event, we do our best to issue an instant refund for that request. If that does not happen automatically, contact [email protected] and we will review and resolve it promptly.
We try to offer refunds when possible but in some instances, some requests cannot be refunded. Especially if the user, in question, has used most of their monthly quota and the paid request was fulfilled successfully, we may not be able to issue a refund.
We reserve the right to determine whether a refund is appropriate based on the circumstances of each case.
User Content and License
You retain rights to your content to the extent permitted by law. You grant Poly a worldwide, non-exclusive, royalty-free license to host, process, transmit, analyze, reproduce, and display your content as necessary to operate, secure, improve, and enforce the Services.
You represent and warrant that you have all rights and permissions necessary for submitted content and that such content does not violate law or third-party rights.
Acceptable Use
You may not use Poly or other products and services of Ethion AI to:
- Violate law, regulation, sanctions, or third-party rights.
- Conduct immoral, unethical, exploitative, manipulative, or abusive activities, even where no specific law has yet prohibited the conduct, including uses that can harm an individual, communities, or the broader public good.
- Generate, request, or distribute disrespectful, exploitative, sexualized, or non-consensual content involving women, children, or any individual, including synthetic imagery that could reasonably be used for harassment, coercion, defamation, exploitation, or other harmful purposes.
- Develop, distribute, or facilitate malware, phishing, fraud, exploitation, or harmful automation.
- Attempt unauthorized access, scraping, reverse engineering, or disruption of the Services.
- Bypass safety features, usage limits, paywalls, or access controls.
- Submit sensitive third-party data without required authorization.
AI Output Disclaimer
AI output may be inaccurate, incomplete, biased, offensive, or unsuitable for your use case. Output is provided for informational purposes only and is not legal, medical, financial, or professional advice. You are solely responsible for verification, decisions, and downstream use.
Third-Party Providers
Poly may rely on third-party model, hosting, payment, and tooling providers. We are not responsible for third-party downtime, policy changes, content, or processing outcomes. Your use of third-party features may also be subject to their terms.
Intellectual Property
Poly, including software, design, branding, and related materials, is owned by us or our licensors and protected by law. Except as expressly permitted, you may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from the Services.
Termination
You may stop using the Services at any time. We may suspend or terminate access immediately for violations, legal risk, security reasons, or abusive behavior. Upon termination, rights granted to you end and we may delete account data according to our retention practices.
Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, uptime, or error-free operation, to the maximum extent permitted by law.
Limitation of Liability
To the maximum extent permitted by law, Poly and its affiliates, officers, employees, and suppliers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business interruption.
Indemnification
You agree to defend, indemnify, and hold harmless Poly and its affiliates from claims, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of your content, your use of the Services, or your violation of these Terms or applicable law.
Export Controls and Sanctions
You may not use the Services in violation of export control, sanctions, or trade laws. You represent that you are not located in, organized in, or ordinarily resident in a restricted jurisdiction where use would be prohibited.
Beta and Experimental Features
Some features may be marked as beta, preview, or experimental. These features may be changed or removed at any time and may have reduced reliability, availability, or support.
Force Majeure
We are not liable for delay or failure caused by events beyond our reasonable control, including internet or cloud outages, third-party provider failures, infrastructure incidents, natural disasters, labor disputes, civil unrest, war, terrorism, or government action.
Dispute Resolution and Class Action Waiver
To the extent permitted by law, disputes will be resolved on an individual basis, and you waive participation in class or representative actions. If a specific dispute resolution process is required by applicable law, that law controls.
Governing Law and Venue
These Terms are governed by applicable law without regard to conflict-of-law principles. Venue for disputes will be the competent courts identified by applicable law, unless mandatory law requires otherwise.
Assignment
You may not assign or transfer these Terms, in whole or in part, without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.
Severability and Waiver
If any provision of these Terms is held unenforceable, the remaining provisions stay in effect to the fullest extent permitted by law. A failure to enforce any provision is not a waiver of our right to do so later.
Entire Agreement
These Terms, together with our Privacy Policy and any additional terms explicitly incorporated by reference, form the entire agreement between you and Poly regarding the Services and supersede prior agreements on the same subject matter.
Survival
Provisions that by their nature should survive termination, including intellectual property, disclaimers, liability limits, indemnification, dispute terms, and payment obligations, survive termination of your access or account.
Changes to Terms
We may update these Terms periodically. Updated Terms become effective when posted unless otherwise noted. Continued use after updates constitutes acceptance.
